Dear Comrades,

Please refer to our previous message dated February 11, 2024 regarding the captioned subject matter.

Our matter was called out for hearing on 08.02.2024 before the Hon'ble bench of Supreme Court. During the argument, it was brought to the notice of the Hon'ble bench by the other side in case of an identical matter (SLP No. 23441/2022 in  Mr. Madi Reddy Vs. Air India Ltd) the Hon'ble Supreme Court (in co-ordinate bench) was pleased to reserve judgment after arguments concluded on 23.01.2024. The bench in our matter granted the liberty to us to mention our matter whenever the reserved judgment in the Air India case is published. Now, the Air India SLP was dismissed by the Supreme Court on 16.05.2024 just before the commencement of summer vacation in SC w.e.f. 18.05.2024 and SC will re-open on July 08, 2024.

It is to bring to the notice of the members that our case is altogether different from the Air India case except one common question of law i.e., date of institution of WP in the High court of Bombay. 

The question raised by the employees of Air India is : 

Whether the delay in disposal of the Writ Petition could be treated as valid ground to sustain the claim of the appellant even against the Private Entity. 

Whereas, we have raised seven more questions of law before the Supreme Court to show the deep and pervasive control of Govt. of India in IDBI Bank which are valid grounds to prove that the IDBI Bank is still a State under article 12 of the constitution of India. 

One of such questions of law made by us is given here for your ready reference:

Whether the direct holding of the Central Government to the extent of 45.48% in IDBI Ltd., and indirect holding through LIC to the extent of 49.24%, does not qualify IDBI Ltd. to be a ‘State’ amenable to writ jurisdiction in terms of ratio laid down by this Hon’ble Court?

Therefore, we will mention our matter before the Hon'ble bench on July 08, 2024 for early disposal of the case. 

Hence, Members of AIIDBIOA who have NOT submitted PRAN to the Bank so far are once again Requested NOT to submit PRAN to the Bank.

Dear Comrades,

The captioned matter was listed on January 17, 2024 (after winter vacation) before Court No. 5 as item no.105, a bench comprising HMJ Hrishikesh Roy and HMJ Prashant Kumar Mishra.  Our matter couldn't reach for actual hearing as the hearing came up to the item no.102 only. Further, the matter was listed on January 18, 2024 (today) before the same bench as item No.104 and the hearing came up to the item no.101 only. 

Senior Counsel, AoR and Advocates from the Petitioner Association were present in the court room and waiting for the matter to be called out for argument. However, item no.101 was heard till the board was discharged for the day.  Expecting the next hearing date as January 24, 2024.

(Note: our matter falls under the regular category after leave is granted, which is listed on the day of Wednesday and Thursday only in a week- As per the roster of Hon'ble Supreme Court).

The captioned matter was listed on December 06, 2023 before Court No.7 as item no.108, a bench comprising HMJ Hrishikesh Roy and HMJ Sanjay Karol.  Our matter couldn't reach for actual hearing as the hearing came up to the item no.101 only.

Further, the matter was listed on December 07, 2023 before the same Bench as item No.105 (at SL No.5 from the top) and the hearing came up to the item no. 101 only. Our Civil Appeal No. 9309 of 2022 before the Honorable Supreme Court was listed before the Bench of Hon'ble Justice Hrikesh Roy (Court No.8) on November 01, 2023 under the regular hearing category.  However, as per Hon'ble SC notification dated October 31, 2023, Justice Hrishikesh Roy was NOT sitting on November 01, 2023. Also, as informed by AoR, the Bench was not taking the matter in physical hearing on November 02, 2023.  Hence, our matter couldn't be taken up for hearing on the date of regular hearing i.e. Wednesday and Thursday this week. 

Our Matter may come up for hearing during this month (November, 2023), if the Bench will take up the physical hearing.    

As the Hon'ble SC has already directed in the Order dated October 17, 2023 that the matter is not to be deleted. Therefore, it will come up for hearing at the earliest.

However, this week was notified as a Miscellaneous week by Hon'ble SC due holidays on the occasion of Dussehra in next week. Thereby, regular matters like ours have not been listed this week. Our appeal at the Honorable Supreme Court (SLP No.21661/2022) is now Civil Appeal No.9309 of 2022 as Leave was granted during first hearing on December 14, 2022. Yesterday (March 15, 2023) when our matter is listed for final hearing, the Bench got changed and the matter is listed at Serial No.101 in Court No.15.

From our side (Petitioner), Senior Advocate, Shri Mukul Rohatgi appeared along with Senior Advocate, Shri Vinay Kumar Garg, Advocate Shri Ankur Chhibber and Advocate Shri Parv Garg.

At around 11.50 a.m. the matter came for hearing and at that time it is understood that on behalf of Respondents No.1 & 3 i.e., the Union of India and the PFRDA no one is present as Certificate of service in respect of respondent no. 1 and 3 still awaited from the concerned High Court as evident from the Office Report dated March 14, 2023 shared by the Assistant Registrar of the Hon'ble Supreme Court at the time of hearing.

Dear Comrades,

Today (December 14, 2022) our appeal (SLP No.21661/2022) at the Honorable Supreme Court was listed at Serial No.24 in Court No.9. At around 11.50 p.m. the matter came for (first) hearing.

From our side (Petitioner), Senior Advocate, Shri Mukul Rohatgi appeared along with Senior Advocate, Shri Vinay Kumar Garg, Advocate Shri Ankur Chhibber and Advocate Shri Parv Garg and submitted the arguments challenging the judgement given by the Hon'ble High Court of Bombay in the matter of writ petition No.2833/2012.

It was submitted to Hon'ble Supreme Court that the writ petition filed in August, 2012 at High Court of Bombay is maintainable as IDBI Bank was owned and run by the Central Government with a promoter stake of "above 51%" at the time of filing the writ petition i.e., in August, 2012. Even today, IDBI Bank is owned and run by the Central Government with direct or indirect (LIC) controlling of stake of more than 92%.

The Hon'ble Supreme Court after hearing the arguments from both sides, passed the Order at around 12.00 noon stating that the matter is fixed for final hearing on March 15, 2023.

Hence, Members of AIIDBIOA who have NOT submitted PRAN to the Bank so far are once again requested NOT to submit PRAN to the Bank.

Dear Comrades,

On September 20, 2022 our matter was listed at Serial No.904 at 3 p.m. before the Chief Justice bench for Pronouncement of Judgement on the preliminary objection to the maintainability of the writ petition.

At 03.10 p.m. the Chief Justice had pronounced the judgement dismissing the writ petition as the same is not maintainable with a liberty to the petitioner to approach the appropriate forum for remedy. Hence, the Court did not go into the merits of the case.

Judgement copy is attached. Kindly go through the same.

A virtual meeting has been scheduled through Microsoft Teams platform from 03.00 p.m. to 05.00 p.m. on 24.09.2022 (4th Saturday) with the members aggrieved by the retrospective implementation of NPS Circular dated 18.04.2012 to understand the meaning and impact of the judgement and to discuss the avenues left over for all of us to resolve the long pending as well as major issue.

Dear Comrades,

On August 10, 2022 our matter has been placed at Sr. No.4 First on Board Category before the Bench of Honourable Chief Justice of BHC. Our matter came up for hearing at 02.30 p.m. Then the Court ordered that all other matters for the day have been discharged (postponed) till 04.30 p.m. to hear our matter. The matter was heard by Hon'ble Chief Justice of BHC till 04.35 p.m. Arguments have been submitted by Senior Advocate from other side (the Bank) for more than two hours on the issue of Maintainability of the case (not on merit of the case).

The Hon'ble Court ordered that the matter is part heard and stand over to Aug 11, 2022 at 2.30 pm.

On August 11, 2022 our matter is kept at Sr.No.904 under supplementary list at 02.30 p.m. and heard by Hon'ble Chief Justice of BHC for more than two hours from 02.30 p.m. to 05.10 p.m.

After hearing arguments advanced by both the parties (the Association and the Bank) on preliminary objections of maintainability, the Hon’ble CJ bench have reserved the judgement on preliminary objections. As per the Court Order, written submissions, if any, should be filed before Saturday (August 13, 2022) evening.

We have filed our written submissions by Saturday afternoon (August 13, 2022)

Pronouncement of the reserved judgement on the preliminary objection to the maintainability of the writ petition is expected very soon.

Dear Comrades,

On July 26, 2022 (yesterday) our matter has been placed at Sr. No.10 before the Bench of Honourable Chief Justice of BHC. At 11.00 a.m. our matter came for hearing. Then the Court ordered that all other matters for the day have been discharged (postponed) till 01.30 p.m. to hear our matter. The matter was heard by Hon'ble Chief Justice of BHC till 01.30 p.m.. As per the Court directions, arguments have been submitted by Shri Vinay Kumar Garg, our Senior Advocate on merit of the case (not maintainability issue) for about two and half hours.

The Hon'ble Court ordered that the matter is part heard and stand over to July 27, 2022 at 11.00 a.m.

Today our matter is kept at Sr.No.901 under supplementary list and heard by Hon'ble Chief Justice of BHC for half an hour from 11.00 a.m. to 11.30 a.m. Arguments have been submitted by Shri Vinay Kumar Garg, our Senior Advocate on merit of the case (not maintainability issue) today also.

Our matter has been placed at Sr. No.7 for today's hearing before the Bench of Honourable Chief Justice of BHC. The matter reached for hearing at 03.30 p.m. and was heard by Hon'ble Chief Justice of BHC. Arguments lasted for more than 45 minutes. Senior Advocates from both sides are present.

Dear Comrades, Due to third wave of COVID-19 pandemic with Omicron variant and increased number of cases in Mumbai, the Honorable High Court of Bombay had issued orders in the first week of January, 2022 stating that from January 04, 2022 to January 28, 2022 Court will work at reduced working hours and only virtual hearing will happen for extremely urgent matters.

Hence, our matter has not come for hearing today along with many other matters initially scheduled for today.

We are expecting next hearing in February, 2022 as there is a chance of resuming physical hearing mode due to reduction in number of COVID-19 cases in Mumbai now.

Dear Comrades,

The matter was fixed at 02.30 p.m. with Serial No.4. on December 16, 2021.

Senior Advocate Vinay Kumar Garg, Advocate Hitesh C Soni, Advocate Ankur Chibber were present on behalf of the Petitioner.

Due to the special bench on the day, the Lordship resumed Court at 03:30 p.m. instead of 02:30 p.m. and thereafter, as a rule productions matter urgent mentions were called up. 

Our Serial No.4 called up at 04.50 p.m. due to which actual arguments could not be started. Sr. Adv asked the court to keep the matter tomorrow for hearing , however, the opposite respondent (Bank) informed that their counsel is not available. The bench was also not agreeing to list it tomorrow. Then, Sr. Adv from our side argued the urgency in the matter as many people died and their money is lying in suspense account, hence prayed to list it on 27th January, 2022 with fixed timing at 2:30 p.m. 

The Bench also pointed to file written synopsis and compilation of judgements. 

Upon which Adv.Hitesh Soni pointed it is readily available in court and the same was informed by Sr.adv to court. 

Hence, the matter was fixed at 02:30 p.m. on 27th Jan 2022.

NPS Court case Update | April 09, 2021 Hearing | All Ind IDBI vs Union of India

Please note that the above captioned matter was listed today (April 09, 2021)  at Serial No.1 through Video Conference mode.

During the hearing, Our Advocate contended that Chamber Summon which is pending to be heard & necessary order be passed today.

However, Honourable Judge mentioned that  the matter needs to be heard physically. 

Advocate for the Bank submitted issue of maintainability to be heard first with Chamber Summon.

Our Advocate mentioned that the issue involves stake of 8,000 Officers.  Hence urgency and requested to keep it in first week of May, 2021.

Update | Hearing 23rd Feb | All India IDBI Off. Ass. Vs. Union of India

The matter was listed today for hearing with Serial No.79. However, during the course of court functioning, the board from Serial No.41 was discharged for the day by the Hon’ble Court. 

Till 5:45 p.m. the court was hearing till serial nos.32. At the same time, the Advocate mentioned the matter before court for early date as the fate of thousands of employees are at stake. The Hon’ble Court have asked to coordinate with court associate for the same. Resultantly, the Advocate have took the request to the court associate. 

Hence, the matter may be listed in the first week of March 2021.

The MSME Ministry is working with the SBI to launch the e-commerce portal for MSMEs that will help them market and sell their products in India and internationally similar to platforms such as Amazon and Alibaba, MSME Nitin Gadkari said. Small Finance Banks (SFBs) have greater concentration of branch network in relatively well-banked States, according to an assessment in the RBI latest monthly bulletin. While there has been a rapid growth in the branch network of SFBs since their inception, this growth has been markedly concentrated in the Southern, Western and Northern regions, which are known as the relatively well-banked regions in the country, RBI officials Richa Saraf and Pallavi Chavan said in an article in the bulletin.

The RBI has imposed a monetary penalty of ₹ 2 Cr on Standard Chartered Bank–India for delays in reporting of frauds. The RBI said the penalty has been imposed on the bank for non-compliance with certain directions issued by it contained in the ‘Reserve Bank of India (Frauds - Classification and Reporting by commercial banks and select FIs) Directions 2016’.

The RBI today withdrew 3 circulars on recovery of excess payments made to pensioners, saying the documents didn’t follow guidelines and court orders.  In a circular issued on March 17, 2016, the RBI had said as soon as the excess payment made to a pensioner comes to the notice of the paying branch, “the branch should adjust the same against the amount standing to the credit of the pensioner’s account to the extent possible including lumpsum (sic) arrears payment.”

HDFC said it plans to sell 24.48% stake in Good Host Spaces Pvt. Ltd for a cash consideration of ₹232.81 Cr. In a regulatory filing, HDFC said it has entered into a share purchase agreement for sale of 47,75,241 equity shares of ₹1 each, representing 24.48% of the issued and paid-up share capital of Good Host.

Competition Commission of India (CCI) has approved the stake acquisition in Max Life Insurance Co by Axis Bank, Axis Capital and Axis Securities. SBI said it has executed two inter-bank short-term money market deals through its Hong Kong branch with the pricing linked to SOFR (Secured Overnight Financing Rate). SOFR is an identified replacement for USD (US Dollar) LIBOR (London InterBank Offered Rate), which is expected to be phased out at the end of 2021. The sunset for LIBOR has been triggered by the decision of the Financial Conduct Authority (FCA) in UK not to compel contributing banks for LIBOR calculation after Dec 2021, the bank said in a statement.

Please note that the above captioned matter was listed today before the division bench of Justice K.K. Tated & Justice Riyaz Chagla. 
Mr. Ramesh Ramamurthy & Mr. Hitesh C Soni appeared from our side.  
The matter came up for hearing for Chamber Summon.
During the hearing, the Designated Senior Advocate for Respondent No.2 have started arguing the matter for a length and had pointed out one Bombay High Court Judgement, stating that IDBI is a private bank, hence, the Writ Petition is not maintainable and hence liable to be dismissed.

Per contra, Mr. Ramesh Ramamurhty have contended that he needs time to file Additional Affidavit in the matter.

Hence, the following order was passed.
Additional Affidavit to filed by petitioner on or before 12th February 2021
Additional Affidavit by Respondent to be file on or before 18th February 2021
Matter to be listed on 23rd February 2021.
The above order dt. 12th Jan 2021 will be communicated once it is uploaded on the official website. Next hearing dt. 23rd February 2021.

Suryakant Mahadik Ji AMAR RAHE AMAR RAHE

Dear Comrades,

With profound grief, it is to inform that our well wisher and mentor, Com.Suryakant Mahadik Ji passed away on January 11, 2021 at around 08.30 p.m. He is aged 74 years.

He was an employee in RBI and became a big leader of RBI employees. He entered into politics and was M.L.A. in Maharashtra through Shiva Sena party. He became President of Bharatiya Kamgari Sena (BKS) of Shiva Sena party and started representing lakhs of workers in thousands of Unions in various Industries in Maharashtra.

He is President of All India IDB Employees' Association.  He was impressed by the role taken by Officers in IDBI Bank in participating in Four days strike call in March ending of 2016 and started guiding us for our struggle against privatisation of IDBI Bank as well as long pending wage revision for 2012-2017.  He is a staunch follower of All India Bank Employees' Association (AIBEA) and believes in struggle; struggle against injustice and exploitation.

Under the banner of United Forum of IDBI Officers and Employees (UFIOE), I met him several times in Mumbai since 2016 for seeking guidance against privatisation issue and wage revision issue for 2012-2017.  Last such meeting happened with him was on February 09, 2020 in Mumbai with agenda on total exit of the Central Government from IDBI Bank (privatisation).  In continuation to this meeting, Twin Banner of AIBEA-AIBOA had announced Strike call against privatisation of IDBI Bank in the last week of March, 2020 which was later deferred due to COVID-19 pandemic.

His sudden demise is a great loss to thousands of Unions in Mumbai in general and our Association in particular.

May GOD give enough strength to bereaved family members to overcome his sudden death.

I am Vikrant Padhee, (Sol ID - 098) sorry to say that, my father has been admitted in Isolation ICU from 29th November and is in critical condition. He is on ventilator due to congestion in chest and retention of CO2 in body (Bilateral Pneumonia).Its been a hardtime, watching Papa suffer. 

He is recovering but still on ventilator since last 19 days. Addingly, it's getting little difficult managing the expenses as it's soaring day by day. I am not able to raise the money to meet his medical expenses and therefore requesting for your help to save his life. ...I would greatly appreciate if you help me to save the life of my father. A welfare scheme to members of AIIDBIOA in the name of “Financial Assistance to the dependants of deceased member of AIIDBIOA” w.e.f. January 01, 2020 is introduced.  Financial Assistance of Rs.1,00,000/- (Rupees one lakh only) (one time lump sum amount) will be given to the dependents of deceased member of AIIDBIOA.  The objective of the scheme is to provide financial support for the immediate needs of the dependants of the deceased member of AIIDBIOA.  This scheme is applicable to all members of AIIDBIOA for whom monthly subscription is being deducted through Salary deduction and also for all members who submitted signed hard copy of Membership Form and salary deduction for monthly subscription is under process.  

Members of AIIDBIOA are requested to bring to the knowledge of office bearers of AIIDBIOA about the incidence of death of member of AIIDBIOA, if any, w.e.f. January 01, 2020 in order to provide financial support for the immediate needs of the dependants of the deceased member of AIIDBIOA under the Scheme.

The above captioned matter was listed today on virtual hearing before Justice Tated Bench at Sr.No.1. At the hearing, Mr. Ramesh Ramamurthy, Mr. Hitesh C Soni & from IDBI Mr. Vithal Koteshwara Rao was present. 

Upon beginning of the VC hearing, Mr. Ramamurthy submitted sum & substance of the WP, however, Hon’ble Justice Tated highlighted the earlier order that this matter if possible to be heard whenever physical hearing is possible. Mr. Ramamurthy than submitted that the Chamber summon is pending & that can be taken & heard finally on VIrtual hearing. Justice Tated called the other side, One Mr. Chunnawala appeared for Respondents. however, due to his connectivity issue, his voice was not audible. 

Justice Tated, taking into consideration our submission have dictated to hear the Chamber Summon first & directed to list on board on 3rd December 2020. i.e., after a week. 

Hence, the matter adjourned & may be listed on 3rd December for hearing of Chamber Summon.
